Rules Governing the Hughes Site
These rules are imposed by the City Manager pursuant to City Code Section 23-140. These rules govern the use of the Hughes Site. The boundaries of the Hughes Site are shown in Exhibit A, which is attached hereto. The requirements and prohibitions of these rules shall not apply to emergency response or law enforcement activities, or to City management and maintenance activities.
Section 1: Prohibitions
It shall be unlawful to:
(1) Enter or remain on the Hughes Site during the hours of 11:00 p.m. to 5:00 a.m.
Section 2: Enforcement
An Assistant City Manager, or their designee, may suspend a visitor from the Hughes Site for a violation of these Rules. Staff who observed the violation will provide the Assistant City Manager with all relevant information in writing. A first violation in a 12-month period shall result in a suspension of seven (7) days from the Hughes Site. A second violation in a 12-month period shall result in a suspension of thirty (30) days from the Hughes Site. A third or subsequent violation in a 12-month period shall result suspension of six (6) months from the Hughes Site.
Section 3: Right to Appeal
A visitor who has been suspended may appeal the suspension decision or the conditions for reinstatement to the City Manager or their designee by filing a written statement of appeal, including the basis of appeal, no later than seven (7) days after the visitor’s receipt of the written notice of suspension. The City staff member hearing the appeal may not be the same individual who made the initial suspension. The decision of the appeal must be given to the visitor in writing, along with an explanation of the basis for the decision. That decision will be considered received on the day it is hand-delivered or emailed to the visitor, or five (5) business days from the date of mailing, if it is mailed to the visitor, and will be the City’s final decision on the matter.
