Will Land Use Code: Phase 2 impact the City's minimum parking requirements?
Yes, the Land Use Code: Phase 2 process will consider parking requirements for land uses within commercial areas and corridors.
Alongside work on Land Use Code: Phase 2, the City will also be working to come into compliance with the State's House Bill 1304, which prohibits municipalities within a metropolitan planning organization (MPO) from enacting or enforcing minimum parking laws for apartments or other multi-family residential projects within one-quarter mile of high-frequency transit lines. The Community Development Office within the Colorado Department of Local Affairs (DOLA) is tasked with implementing various bills passed during the 2024 legislative session. While DOLA is still preparing to launch compliance tools and resources, they will preliminarily publish a draft map of applicable transit areas by September 30, 2024.
The deadline for compliance with House Bill 1304 to no longer enact or enforce parking minimums is June 30, 2025.
